Draft a letter of instruction to a medical expert

Use this orthopaedic example to prepare a letter of instruction from the material in your matter. Adapt the recipient, questions and enclosures to the expert's specialty and your case.

Draft a letter of instruction to an orthopaedic surgeon about [client]. Use these headings: Executive summary; Background facts; Request for opinion; Enclosures; Overarching obligations and court rules. Distinguish facts from disputed accounts and identify missing records. List proposed enclosures for me to check.

Add the particular issues you need the expert to address, such as diagnosis, causation, prognosis or future treatment. Identify the relevant period and records where useful.

Review the proposed plan and completed draft. Check the client's details, the factual assumptions and the questions. Check each proposed enclosure against the material you intend to send: a list in a draft does not establish that the file is attached.

Supply and check the applicable expert obligations and court requirements for your jurisdiction. The heading alone is not a statement that the letter complies with them.
